Dreamscape Adventure Treks Pvt. Ltd. | Dreamscape Treks | Himalaya & Beyond

Draft for company/legal review · effective date to be confirmed

These Terms & Conditions constitute the agreement between Dreamscape Adventure Treks Pvt. Ltd. (“Dreamscape Treks”, “Dreamscape”, “we”, “us” or “our”) and the person making a booking or participating in a trip (“Client”, “Traveller”, “you” or “your”).

They apply to trekking, tours, climbing, mountaineering expeditions, adventure activities and other travel services arranged or operated by Dreamscape.

By making a booking, paying a deposit, making any payment, or confirming participation in a Dreamscape trip, you acknowledge that you have read, understood and accepted these Terms & Conditions.

1. Our Services

Dreamscape Treks is a Nepal-based trekking and adventure travel company offering travel experiences in Nepal, Tibet, Bhutan and India, including trekking and hiking; cultural and sightseeing tours; peak climbing; mountaineering and major expeditions; adventure travel; special-interest journeys; selected rafting and bungee-jumping activities; transportation and accommodation arrangements; and other travel services described in individual itineraries.

Dreamscape primarily operates trekking and mountain-related services directly and may arrange certain services through qualified local or specialist partners.

Partner-arranged services may include transportation, accommodation, rafting, bungee jumping, helicopter services, specialist climbing services and other activities.

For trips or services operated by partners in Nepal, Tibet, Bhutan, India or elsewhere, the Client will be informed of the applicable partner's terms and conditions before booking where those terms materially apply to the service.

2. Formation of the Booking Contract

A booking becomes confirmed when Dreamscape has received the required booking information, the Client has supplied the necessary documents, the required deposit has been received, and Dreamscape has issued written confirmation, an invoice or other booking confirmation.

A quotation, itinerary proposal or inquiry does not constitute a confirmed booking until Dreamscape confirms it in writing.

Once confirmed, the booking becomes subject to these Terms & Conditions together with the specific itinerary, quotation, invoice and any additional conditions communicated to the Client.

3. Booking on Behalf of Other Travellers

If you make a booking on behalf of another person or group, you confirm that you have authority to provide their information and accept these Terms & Conditions on their behalf.

The person making the booking is responsible for ensuring that all information supplied for the other travellers is complete and accurate.

All travellers remain responsible for complying with the conditions applicable to their individual participation.

4. Booking Requirements

Depending on the destination and type of trip, Dreamscape may require completed booking information, passport copy, passport-size photograph, emergency contact details, visa information, travel insurance information, permit-related documents, medical or fitness information relevant to the trip, and other documents required by government authorities or service providers.

Clients must ensure that all information provided is accurate.

Dreamscape is not responsible for costs or consequences resulting from incorrect, incomplete or late information provided by the Client.

5. Deposit and Payment

A 30% deposit of the total trip cost is required to confirm a standard Dreamscape booking unless a different deposit requirement is stated in the specific quotation or booking confirmation.

The standard 30% deposit is non-refundable if the Client cancels the booking, subject to the Cancellation & Refund Policy.

Eligible bookings may be postponed and the applicable amount retained as future travel credit in accordance with the Dreamscape postponement policy.

The remaining balance must be paid according to the payment schedule stated in the booking confirmation or invoice.

Certain trips may require full or earlier payment because of permits, flights, accommodation, government requirements or third-party supplier conditions.

6. Payment Methods and Charges

Dreamscape may accept payment by bank transfer, credit or debit card, online payment system, cash, or other payment methods approved by Dreamscape.

Bank charges, international transfer charges, currency-conversion charges and payment-processing fees may be payable by the Client where applicable.

The applicable payment charges will be communicated before payment where they are known.

7. Trip Prices

Prices are based on the services and inclusions stated in the applicable itinerary, quotation or booking confirmation.

Prices may change before booking confirmation because of government fees and permits, airline or transportation costs, currency fluctuations, fuel prices, accommodation costs, seasonal pricing, conservation or national park fees, third-party supplier charges, or changes in applicable taxes or regulations.

Once a booking has been confirmed, the agreed price will normally remain applicable unless additional costs arise from Client-requested changes, government requirements, third-party price changes specifically permitted under the booking, or circumstances beyond Dreamscape's reasonable control.

8. Cancellation, Refund and Postponement

The Client may cancel or request postponement of a confirmed booking in accordance with Dreamscape's Cancellation & Refund Policy.

Dreamscape encourages Clients who are unable to travel on their original dates to consider postponement rather than cancellation, where operationally possible.

A postponement may allow the amount paid to remain available as trip credit for future travel instead of being forfeited under the cancellation policy.

9. Trip Postponement and Travel Credit

A Client may request postponement by providing written notice to Dreamscape before the scheduled departure date.

Where postponement is approved, the booking may be moved to a future departure date; eligible amounts already paid may be retained as travel credit; the Client may select another Dreamscape itinerary subject to availability; if the new trip costs more, the Client must pay the difference; if it costs less, treatment of the difference will follow the applicable booking conditions; and non-recoverable third-party charges may remain subject to the original supplier's conditions.

Postponement is subject to operational feasibility, permit availability, seasonal conditions and supplier availability.

The exact validity period of trip credit will be stated in the postponement confirmation. Unless otherwise stated, Dreamscape recommends a 24-month validity period for standard trip credit.

10. Partner-Arranged Services

Dreamscape may arrange selected services through independent partners in Nepal, Tibet, Bhutan, India and other destinations.

These may include rafting, bungee jumping, helicopter services, transportation, accommodation, specialized climbing services, local sightseeing, adventure activities and other specialist travel services.

Where a service is provided by a partner, Dreamscape will communicate the relevant partner's applicable terms and conditions to the Client before the booking is confirmed, where those conditions materially affect the service.

The Client must review and accept those conditions before booking the relevant service.

Where a partner cancels a service or a service cannot be provided and the partner refunds an amount to Dreamscape, Dreamscape will pass that refund to the Client in full to the extent that Dreamscape actually receives it from the partner. Dreamscape will not retain an amount refunded by the partner for its own benefit.

Where a partner does not provide a refund, Dreamscape cannot guarantee a refund for that particular partner-arranged service, unless Dreamscape has separately agreed otherwise. Dreamscape will make reasonable efforts to communicate with the partner and assist the Client where appropriate.

11. Changes to the Itinerary

Mountain and adventure travel is affected by weather, terrain, permits, transportation, local conditions and other factors.

Dreamscape reserves the right to modify an itinerary where reasonably necessary for safety, weather, environmental conditions, government requirements, permit restrictions, road or trail conditions, transportation disruption, flight schedules, operational requirements, or other circumstances beyond reasonable control.

Dreamscape will make reasonable efforts to provide an alternative arrangement of comparable value where practical.

An itinerary is a planned program and not a guarantee that every location, activity, summit or destination can be reached.

12. Trekking, Peak Climbing and Expeditions

Trekking, peak climbing and mountaineering expeditions involve inherent risks including high altitude, altitude sickness, extreme weather, snow and ice, avalanches, rockfall, landslides, difficult terrain, river crossings, falls, injury, illness, hypothermia, limited access to medical facilities, flight or transportation disruption, and other natural or operational hazards.

Major expeditions and peak-climbing programs may involve specialist guides, climbing personnel, expedition logistics, permits, high-altitude camps, transportation, communication systems and emergency arrangements.

Summit success is never guaranteed.

Failure to reach a summit because of weather, route conditions, safety concerns, health, acclimatization, government restrictions or other circumstances does not by itself constitute a failure to provide the contracted expedition services.

13. Travel Insurance

Appropriate travel insurance is mandatory for all Dreamscape Clients.

The Client must obtain insurance before travel and maintain valid coverage for the entire journey.

For trekking, climbing and expedition programs, the insurance must cover the maximum altitude and activities included in the itinerary.

Insurance should include appropriate cover for medical expenses, emergency evacuation, helicopter rescue, repatriation, accidental injury, trip cancellation, trip interruption, flight disruption where applicable, baggage and personal belongings, natural disasters, and adventure activities relevant to the trip.

The Client is responsible for checking policy exclusions, altitude limitations, activity restrictions, deductibles and claim procedures.

Dreamscape may request evidence of insurance before departure.

14. Health, Fitness and Medical Conditions

The Client is responsible for determining whether they are medically and physically suitable for the chosen trip.

Clients should obtain professional medical advice before participating in demanding physical activities or high-altitude travel.

Clients must inform Dreamscape of any relevant medical condition, allergy, medication requirement, disability or other circumstance that may affect safe participation.

Dreamscape may require a Client to stop or withdraw from an activity where, in the reasonable judgment of the guide, expedition leader, medical professional or operational team, continuing would create a significant safety risk.

15. Emergency Rescue and Evacuation

In an emergency, Dreamscape will make reasonable efforts to coordinate available assistance, which may include helicopter evacuation, road evacuation, medical assistance, guide or porter assistance, alternative transportation, or other available rescue arrangements.

The costs of rescue, evacuation and medical treatment are the Client's responsibility unless covered by insurance or expressly included in the trip price.

Dreamscape may assist with communication and reasonable documentation required for an insurance claim.

16. Flights and Transportation

Domestic flights, particularly flights serving remote mountain destinations, may be delayed or cancelled because of weather, visibility, airport conditions, technical issues, air traffic restrictions or other operational reasons.

Dreamscape will make reasonable efforts to assist with alternative arrangements.

Additional expenses arising from such disruption may be payable by the Client unless included in the trip price or covered by insurance.

Clients should allow adequate contingency time when connecting domestic and international flights.

17. Visas and Permits

Clients are responsible for meeting the visa and immigration requirements applicable to their nationality and destination.

Dreamscape may assist with visa-related information and permits where such services are included.

Government authorities retain the final authority to approve or refuse visas and permits.

Dreamscape does not guarantee approval of any visa, permit or immigration application.

18. Restricted Areas

Certain areas of Nepal and other destinations require special permits, licensed guides, minimum group sizes or other government requirements.

Clients travelling to restricted areas must comply with all applicable regulations.

Changes to government requirements may require changes to an itinerary or travel date.

19. Accommodation and Meals

Accommodation and meals will be provided according to the applicable itinerary.

Accommodation standards may vary considerably between cities and remote mountain regions.

Dreamscape may substitute accommodation with another property of a comparable standard where reasonably necessary.

Special dietary requirements should be communicated at booking but cannot always be guaranteed in remote locations.

20. Client Conduct

Clients must behave respectfully toward staff, guides, fellow travellers, local communities, accommodation providers, government authorities and the environment.

Dreamscape may terminate a Client's participation where the Client creates a serious safety risk, threatens or harms another person, engages in illegal activity, seriously damages property, or seriously disrupts the trip.

In such circumstances, no refund will normally be provided for unused services, and additional costs arising from the Client's conduct will be the Client's responsibility.

21. Illegal Activities

Clients must comply with the laws and regulations of the countries and regions they visit.

Dreamscape is not responsible for consequences resulting from a Client's unlawful conduct, including arrest, fines, detention, deportation or removal from a trip.

22. Personal Belongings

Clients are responsible for their passports, money, electronics, luggage, equipment and other personal belongings.

Dreamscape recommends that Clients maintain adequate insurance for valuable possessions.

23. Incomplete Trips and Unused Services

No refund will normally be provided for services voluntarily unused by a Client after the trip has commenced, including where the Client leaves the trip early, chooses not to participate, misses scheduled transportation, decides not to continue trekking, is unable to continue because of personal circumstances, or otherwise chooses not to use an included service.

Where non-completion results from illness, injury or safety concerns, Dreamscape will make reasonable efforts to assist with onward arrangements.

Additional costs remain the Client's responsibility unless covered by insurance.

24. Force Majeure

Dreamscape will not be responsible for failure, delay or modification caused by circumstances beyond its reasonable control, including natural disasters, earthquakes, floods, landslides, avalanches, severe weather, epidemics or pandemics, war, civil unrest, government restrictions, border closures, strikes, road closures, airport closures, flight disruption, security situations, changes in government regulations, or other extraordinary events.

Dreamscape will make reasonable efforts to provide alternative arrangements where possible.

25. Complaints

Clients should report any problem to the guide, trip leader or Dreamscape representative as soon as reasonably possible.

Prompt notification gives Dreamscape an opportunity to investigate and resolve the issue during the trip.

Formal complaints should be submitted in writing within a reasonable period after completion of the trip.

26. Photography and Video

Dreamscape may take photographs or videos during trips for operational, documentary and promotional purposes.

Clients who do not wish to appear in promotional materials should notify Dreamscape in writing.

Dreamscape will respect applicable privacy requirements when using identifiable images.

27. Privacy

Dreamscape collects and processes personal information required to provide travel services, communicate with Clients, process bookings, obtain permits, coordinate transportation and accommodation, meet legal obligations and provide emergency assistance.

Personal information will be handled according to the Dreamscape Privacy Policy.

28. Website Information

Dreamscape makes reasonable efforts to maintain accurate website information.

However, prices, routes, availability, permits, schedules, regulations, accommodation, transportation and other travel information may change.

Website photographs and descriptions are intended as general representations and may not exactly reflect conditions at the time of travel.

29. Limitation of Responsibility

Dreamscape will exercise reasonable care in arranging and operating its services.

However, adventure travel involves inherent risks and certain services are provided by independent third parties.

To the extent permitted by applicable law, Dreamscape will not be responsible for losses arising from circumstances beyond its reasonable control or from the acts or omissions of independent third-party providers.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

30. Applicable Law

These Terms & Conditions are governed by the laws of Nepal.

Any dispute should first be addressed through good-faith communication between the Client and Dreamscape.

Where a dispute cannot be resolved amicably, it shall be subject to the applicable jurisdiction of the courts of Nepal.

31. Updates to These Terms

Dreamscape may update these Terms & Conditions when necessary to reflect changes in law, regulations, services or operational requirements.

The version applicable to a confirmed booking will generally be the version accepted by the Client at the time of booking, unless a change is required by law or otherwise agreed.

32. Acceptance

By booking a Dreamscape trip, making a payment or confirming participation, the Client confirms that the information provided is accurate; these Terms & Conditions have been read and understood; the payment and cancellation conditions are accepted; the Client understands the inherent risks of adventure travel; appropriate travel insurance will be maintained; applicable laws and safety instructions will be followed; and these Terms & Conditions form part of the booking agreement.
